These General Terms and Conditions (GTC) govern the relationship between you as a customer and Jungfrau Region Tourismus AG, Kammistrasse 13, 3800 Interlaken, Switzerland (hereinafter referred to as JRT) for all bookings made on the online booking platforms jungfrauregion.swiss, grindelwald.swiss, wengen.swiss, muerren.swiss, lauterbrunnen.swiss, haslital.swiss and via the JRT reservation centre (hereinafter referred to as the booking platform). JRT reserves the right to amend these GTC at any time without prior notice. The version in force at the time of booking is authoritative.

For reasons of easier readability, the female designation is omitted.

A. JRT is an intermediary

A. 1. JRT is an agent for tourism services

The JRT provides the providers of tourist services in the Jungfrau Region with the booking platform for the sale of their services (third-party services). The customer concludes the contracts directly with the service providers selected by them (for the contractual conditions of the individual service providers, see Chapter D below. JRT is not a party to these contracts and is therefore not liable for the correct fulfilment of the contract. JRT is commissioned by the affiliated service providers to handle the booking and collect the booked services on their behalf (collection mandate).

A. 2 Trips organised by the customer

The customer can combine the services listed on the booking platform, such as hotels, mountain railway tickets, excursions, equipment, etc., to create a complete holiday package tailored to their needs. The customer is responsible for selecting, compiling and coordinating the individual items (in terms of time, location, etc.). JRT is under no obligation to check the composition of the shopping basket for the correct selection, composition and coordination of the individual items.

Even if the customer books different services at the same time, he concludes a separate contract with the selected service provider for each item in the shopping basket. Each contract exists independently of the other services booked.

A. 3. own services provided by JRT

In exceptional cases, JRT offers packages in its own name. These are labelled separately. The provisions in Chapter C and in Chapter D.

B. General provisions

B. 1 General terms of use for the booking platform

By accessing and using the booking platform, the visitor or customer recognises these General Terms and Conditions of Contract and the General Terms and Conditions of Use and Data Protection (hereinafter GTCU) for jungfrauregion.swiss, grindelwald.swiss, wengen.swiss, muerren.swiss, lauterbrunnen.swiss and haslital.swiss. If the visitor or user does not agree with these terms and conditions, they must cease use immediately.

In accordance with the GCU, JRT does not guarantee the continuity or unrestricted availability of the website and therefore cannot be held liable for the consequences of interruptions in the booking process or the non-transmission of messages or system failure.

B. 2 Geographical scope of application

The booking platform is intended for the European region (Switzerland and EEA countries). Accessibility to the platform from outside this region is not guaranteed by JRT.

B. 3 Country-specific restrictions

Visitors residing in a country that is not listed on the booking platform cannot open an account and cannot book services via the platform. If the visitor enters an incorrect country of residence in the shopping basket during the payment process in order to make the booking, no contract will be concluded.

B. 4 Tenders

The services advertised on the platform are not binding offers on the part of JRT or the individual service providers. The service providers create the service descriptions etc. on their own responsibility. JRT and the individual service providers reserve the right to change tenders and prices at any time or to discontinue services in whole or in part. The information and prices in the shopping basket before the definitive booking are decisive for the conclusion of the contract.

The websites of the platforms contain general information about the localities, weather conditions, opening hours of shops, restaurants and public facilities, swimming pools, sports facilities, etc., a calendar of events, etc. This information is intended as a general guide. This information is provided for general guidance. They are not guarantees on the part of the service providers or JRT and do not form part of the contract. Such services may be offered by third-party companies (third-party services), for which neither JRT nor the booked service providers are responsible.

B. 5 User account for bookings via the JRT websites

In order to book services via the booking platform, the customer must open a user account.

The customer undertakes to provide truthful information. They must be at least 18 years of age, or if a higher age applies in their country of residence for full legal capacity, the customer can only open an account and book services once they have reached this age.

The customer account may not be opened under a fictitious name or pseudonym. The permanent address of residence must be provided, including the correct details of the country of residence.

The jungfrauregion.swiss user account (and all associated pages) stores the data required to process transactions relating to the shopping basket, such as user name, password, first and last names, addresses, ski pass number, gender, strength class, travel dates, etc. The e-mail address specified in the user account is used to send booking confirmations, invoices, notifications regarding services (e.g. print@home tickets, etc.). Booking confirmations, invoices, notifications regarding booked services (e.g. print@home tickets) etc. are sent to the e-mail address specified in the user account. The sending of at least one regular newsletter is also activated by default. The newsletters can be deactivated in the user account.

The customer is responsible for the accuracy and updating of the data. If the customer enters details of third parties, he must have the appropriate authorisation himself. It is in the customer's own interest to keep the access password secret. If misuse of the account is suspected, JRT must be contacted immediately. Credit card data is not processed in JRT's systems; this is done solely by the specialised service providers linked to the checkout.

All bookings etc. processed via the customer account are attributed to the account holder. JRT fulfils its obligations when it sends emails, confirmations, invoices, etc. to the addresses specified in the user account.

The cancellation of a user account can be requested in the user account itself. However, deletion is not possible as long as there are still valid (non-expired) subscription authorisations in the user account. In this case, an error message is displayed. The user account is no longer accessible after cancellation, cannot be reactivated and all services associated with the user account such as newsletters, ad hoc messages, etc. are discontinued. Internally, the user account remains stored until the end of the statutory retention period and is accessible to administrators; it is then irrevocably deleted.

B. 6 Jungfrau Winnercard

The Jungfrau Winnercard additional service can be opted for in the user account. If this is done, participation in the Skiline system is agreed to (conditions of use and system description). Additional personal data (in particular information from control systems in the ski lift system) or video recordings made on special race courses or in fun parks are stored and processed electronically. For this service, Jungfraubahnen Management AG utilises the services of Skiline Media AG, Seedammstrasse 3, 8808 Pfäffikon, Switzerland. It passes on data from the user account to this company so that an additional account is created on the Skiline Internet portal (www.skiline.cc). The Jungfrau Winnercard service results from the Skiline functions configured for the Jungfrau Ski Region. This service is personalised (e.g. by entering the Sportpass number), controlled and accessed via jungfrau.ch. In the user account, the degree of publicity of one's own services (private or public profile, user picture, user name, publishing ski movies) can be defined. The activation of the Jungfrau Winnercard service can be linked to competitions, the awarding of prizes or honours. No correspondence will be entered into about such competitions, there is no personal entitlement to any benefits, and there is no legal recourse. The following groups of people are excluded from participating in competitions:

  • JE3 Dependants Retired dependants JSR
  • JE2 Employees and retirees JSR
  • JS5 Ski instructor JSR
  • JS3 Ski club JO assistant leader
  • JS2 Ski instructor with JSR licence
  • JE0 free season ticket

Deactivating Jungfrau Winnercard or deleting the user account does not delete the Skiline account. It can still be used for another ski area, for example. However, participation in Skiline can be cancelled at any time by entering the relevant details online at www.skiline.cc or by sending an email to support@skiline.cc.

B. 7 Conclusion of contract

B.7.1 Booking via the JRT website
By placing services and goods in their shopping basket and clicking the "Order for a fee" button, the customer submits a binding request to the service providers they have selected to conclude contracts in accordance with the individual items in the shopping basket. If the customer places various services in the shopping basket, he concludes a contract with each individual service provider selected by him, which is independent of the other contracts.

Before finalising the booking, the customer is shown a summary of the selected services. The prices contained therein are guaranteed by the system for 30 minutes. If the customer wishes to finalise their booking after 30 minutes, the prices will no longer be valid. The customer will be informed accordingly and must re-initiate the order process for his own security.

The customer is bound by their request for 48 hours. During this period, JRT will check the definitive availability of the order items on behalf of the service providers and, if the services are available, will debit the price via the payment method selected by the customer on behalf of the service providers. Within this period, JRT will inform the customer of the conclusion of the contract on behalf of the service provider. JRT does this by sending the customer confirmation of the conclusion of the contract via an advert on the website (SuccessPage) and by email.

If the selected services or individual services are not available or if the price cannot be debited via the specified means of payment, the customer will receive a corresponding notification within this period. Even if only one service is not available, the entire booking cannot be accepted. In this case, the customer must rebook the available services.

B.7.2 Booking via the JRT reservation centre
It is possible to book services via the JRT reservation centre. On request, the reservation centre will prepare a non-binding travel proposal. This will be sent to the customer by e-mail, fax or letter as requested. The availability of the proposed services is not guaranteed. The customer is free to accept the proposal by telephone, e-mail, fax or letter. By instructing JRT to make the booking, the customer provides JRT or the selected service providers with a binding offer. The customer is bound by this offer for as long as it takes in the normal course of events (in particular the chosen means of communication) for the acceptance of the booking to be received. JRT is free to accept the booking. If JRT refuses to conclude the contract, it will inform the customer as soon as possible.

The contract is finalised upon acceptance of the booking.

Once the booking has been made, JRT will send the customer the booking confirmation with invoice and payment information by the means of communication chosen by the customer (e-mail, fax, post).

B. 8 Contract content and environmental and general conditions

The content of the contract results from the services put together by the customer in the shopping basket, and the booking with the reservation centre, and the booking confirmation in conjunction with the associated service descriptions. General descriptions of locations, infrastructure, (public) events and average weather conditions are not assurances and do not form part of the contract (details under B. 4.).

B. 9. Booking for multiple participants

If the customer books services for other participants, only the booking customer is a contracting party for the service providers and JRT. The customer is responsible for paying for all booked services, and JRT is authorised to bill or invoice all services via the customer's credit or debit card or customer account. The booking customer is responsible for the fulfilment of the obligations of all participants.

B. 10. prices

The price to be paid for the individual service selected may depend on the selected season, length of stay, the selected service features (e.g. hotel room category), etc. The final price appears in the shopping basket. The final price appears in the shopping basket. If the customer books several services, his payment obligation is for the total of all services booked. The prices are to be paid in Swiss francs. Unless expressly stated otherwise, the prices include all surcharges, taxes and duties, including Swiss VAT. Prices in EURO are for general information only and are not binding. The obligation to pay is in Swiss francs.

For bookings via the JRT reservation centre, payments in foreign currencies are possible by express agreement.

B. 11. terms of payment

B.11.1 Terms of payment for online bookings
The services according to the individual shopping basket items must be paid for when the contract is concluded. As soon as JRT has received payment and the services have been confirmed by the service provider, JRT will send the corresponding confirmation to the customer. If the customer fails to pay, the contracts will not be concluded. In this case, the customer will be informed immediately. The customer and JRT are responsible for any fees incurred as a result of payment processing.

B.11.2 Terms of payment for bookings via the JRT reservation centre (telephone, email, fax, etc.)
Jungfrau Region Tourismus AG issues a confirmation, which is valid as a contract, with credit card payment at the time of booking. This applies to bookings of a package, a holiday flat, a hotel room or other services such as events, sports equipment hire and so on).

B.11.4. revocation of credit card payments, late payments, etc.
If the credit card payment is not honoured or the credit is revoked, this will be considered a cancellation and the cancellation costs will be charged according to the conditions of the booked services (Chapter B. 15. and Chapter D). If payments for bookings via the reservation centre are not made on time, the reservation centre may cancel the booking after a short grace period has elapsed without success and charge the corresponding cancellation costs.

B. 12. Delivery of vouchers / e-tickets and rechargeable data carriers for online bookings and e-mail dispatch

The order confirmation serves as proof of the contracts concluded. However, the order confirmation is not the voucher, ticket or e-ticket for purchasing the services. A link on the order confirmation refers to the customer's user account, where - depending on the product - the customer can download the necessary documents (vouchers, tickets, e-tickets, etc.) or load a data carrier. Additional information may be required for the passes before printing, such as the exact date of travel and personal details for train tickets or weight details for ski hire.

Vouchers, tickets, e-tickets etc. must be printed out by the customer for their intended use (print@home). An exception to this are the 4 data carriers for ski passes, which may be charged, sent or handed over (see the explanations in section D.). Copying, modifying or reproducing the subscription authorisations is prohibited and punishable by law.

The customer shall ensure that his vouchers, tickets, e-tickets, etc. are protected against theft, misuse, unauthorised duplication, etc. They must note that in the case of impersonal vouchers, tickets, e-tickets, etc., the first person to present the valid document is deemed to be the authorised party. The service providers are not obliged to check the identity or authorisation of the holder of the document. In such cases, no duplicates of lost documents etc. can be issued. Neither the service providers concerned nor JRT are obliged to make any refunds, pay compensation, etc.

The documents printed out by the customer (vouchers, tickets, e-tickets, etc.) must be dry, unsoiled, undamaged, uncreased and in a legible condition. They may have a barcode that can be checked electronically. The documents must not be folded in the area of the barcode.

B. 13. Delivery of vouchers / e-tickets and rechargeable data carriers for bookings via the JRT reservation centre

Vouchers, tickets and other travel documents will be sent to the customer after receipt of payment by the means of communication chosen by the customer (e-mail, fax or post).

Furthermore, the provisions under B.12. also apply by analogy to bookings made via the JRT booking centre.

B. 14. no right of cancellation, no right of return

There is no statutory right of cancellation or return for tourist services, holiday flats and holiday homes, tickets etc. with an agreed period of validity or fixed dates.

B. 15 Cancellations, cancellations or rebookings

If the customer wishes to cancel or rebook (individual) services, they must notify the JRT helpdesk. The relevant contact details can be found on the booking confirmation. Cancellations or rebookings via the user account are not possible.

The cancellation and rebooking conditions for the individual services can be found under C.1.3. to C.1.5. and in Chapter D. in the respective tenders. JRT draws the customer's attention to the fact that the cancellation and rebooking conditions for the various services may vary considerably. It is also possible that the cancellation fee for certain services may be 100% from the time of booking.

The cancellation or rebooking of an individual service does not affect the other contracts concluded. These remain in full force and effect.

JRT recommends taking out the cancellation insurance offered during the ordering process. This covers the cancellation costs in cases of hardship. The insurance benefits are described in detail in the insurance policy. The premium for the cancellation insurance remains payable in all cases.

Termination of contractual relationship
Unless otherwise agreed, contractual relationships are concluded for an indefinite period. Unless otherwise stipulated in individual contracts, the cancellation period is 3 months.

B. 16 Conditions of participation, obligations of the customer and other participants to co-operate

Depending on the service booked, there may be conditions of participation or obligations to co-operate. The customer and any other participants undertake to comply with these conditions and to follow the instructions of guides, ski instructors, snowboard instructors, mountain guides, etc. etc. The customer and other participants acknowledge that the guides, ski instructors, mountain guides, etc. may exclude the customer and participants from an activity. The customer and other participants acknowledge that the guides, ski instructors, mountain guides, etc. may exclude the customer and participants from an activity if these conditions are not met or the instructions are not followed. In this case, the price paid will not be refunded. In addition, this may result in the loss of all rights to compensation and other rights.

B. 17 Means of communication used and transmission of data

JRT has fulfilled its notification obligation as soon as the relevant data has been sent from the JRT system by email or entered into the customer's account. At this point, the risk for the correct delivery of the e-mail or the display of the corresponding web pages on the customer's screen is transferred to the customer. If discrepancies occur during the booking process, if no error message appears after pressing the "Book with costs" button or if the customer does not receive the confirmation emails etc. within a reasonable period of time, the customer must contact the JRT helpdesk immediately.

In the case of e-mails, the time of delivery is deemed to be the time of dispatch to the JRT; in the case of postal traffic, it is assumed that letters with priority delivery were delivered no later than four days after posting at a Swiss post office, even abroad, unless there is proof to the contrary.

JRT draws the customer's attention to the fact that the transmission of e-mail messages via public networks is unprotected and can be intercepted, read and modified by third parties. In addition to the content, the sender and recipient of the email can also be recognised by third parties. This also applies to e-mails used for communication with JRT. JRT is not liable for any damage resulting from defective, disrupted or intercepted transmission of an email. These provisions apply analogously to other unprotected forms of communication (e.g. SMS) that are comparable in terms of their functionality and risk situation and that are used here or in the future.

The customer is responsible for ensuring adequate protection against viruses and other malware.

C. JRT services and JRT's liability provisions

C. 1 JRT flat rates

JRT packages are labelled separately on the platform. Packages are pre-arranged combinations of several services such as excursions and accommodation or accommodation and ski pass at a total price. In these cases, JRT acts as the contracting party. These packages can only be purchased as a complete package. The provisions above apply to these packages. The delivery of the purchase authorisations (vouchers, tickets, etc.) is carried out separately for the individual service components.

C.1.1 Place of departure
The start of a package holiday shall always take place within Switzerland. The organisation of any travel (from abroad) to the place of departure in accordance with the booked travel programme is the responsibility of the customer and is not included in the package. Foreign customers are advised to find out about the entry formalities for visiting Switzerland before booking.

C.1.2 Changes to the programme and services before the start of the package
JRT reserves the right to offer appropriate replacement services or to change the programme accordingly if, due to unforeseeable or unavoidable events, force majeure (e.g. natural disasters, epidemics, unrest), official measures of any kind or strikes, certain services cannot be provided in the agreed manner or the agreed programme has to be changed. JRT will inform the customer immediately and notify them of the impact on the price.

C.1.3 Cancellations, cancellations or rebookings of the package by the customer
By booking a package, the customer concludes a contract with JRT. Packages that have been booked via the JRT booking platform can only be cancelled or rebooked via the JRT helpdesk. If a cancellation or rebooking is made 14 days or more before arrival, the cancellation fee is 100% of the booked package price, unless other cancellation conditions have been specified. If a cancellation or rebooking is made more than 14 days before arrival, a processing fee of CHF 50 will be charged. Local taxes are included in the prices. Extras such as minibar, room service, car park fees, etc. as well as services not mentioned in the package description will be invoiced separately by the service provider. The customer is advised to enquire about the extras and their price.

C.1.4 Cancellation of the package by JRT
C.1.4.1 Cancellation for reasons attributable to the customer or participant
JRT is entitled to cancel your package if you give justified cause for this through actions or omissions. In this case, JRT will refund the price already paid; any further claims are excluded. JRT reserves the right to claim any costs and damages already incurred.

C.1.4.2 Unforeseeable events, force majeure, strikes
If unforeseeable or unavoidable events, force majeure (e.g. natural disasters, epidemics, unrest), official measures of any kind or strikes make the trip considerably more difficult, dangerous or impossible, JRT may cancel the trip. In this case, JRT will refund the travel price paid (insurance premiums will not be refunded or remain payable). Further claims are excluded. C.1.5 Programme changes, cancellation of services during the package

C.1.5.1 General service and programme changes
JRT shall endeavour to carry out the package as agreed. Nevertheless, changes to the service and programme may occur. In such cases, JRT will offer an equivalent solution as far as possible. If the remedy causes excessive costs or disproportionate effort for JRT, JRT may refuse to remedy the situation. Any additional costs will be borne by the traveller.

C.1.5.2 Force majeure
If programme and service changes or service cancellations are caused by force majeure, JRT may refuse to remedy the situation. Any additional costs shall be borne by the traveller.

C.1.5.3 Reduction in price
If the change to the service or programme affects a significant part of the agreed package, JRT will reimburse any objective reduction in value between the agreed price and that of the services provided. This claim is limited to the price of the package.

C.1.6 Customer or participant starts the trip but is unable to complete it, services not used
If the customer or fellow traveller cancels the package prematurely or does not use certain services, the price of the travel arrangement or the services not used cannot be refunded. Any services not used will be refunded, less an appropriate processing fee, provided that they are not charged to JRT and are not completely insignificant services or the refund does not conflict with statutory or official regulations. In urgent cases (e.g. own illness or accident, serious illness or death of a close relative), the service provider or JRT will assist as far as possible in organising the early return journey. Any costs, e.g. for transport, etc., shall be borne by the customer or fellow traveller. JRT recommends taking out return travel insurance, which is not included in the price of the trip. Further details are available on request from JRT.

C.1.7 Complaint period and request for remedy
If the package does not comply with the contractual agreement or if the customer or a fellow traveller suffers damage, the customer (or fellow traveller) is obliged to complain to JRT immediately about this defect or damage and request remedy free of charge. JRT will endeavour to rectify the defect or damage within a reasonable period of time.

Any compensation and other claims must be reported to JRT within 4 weeks of the contractual end of the package. If the customer or fellow traveller fails to notify JRT during the trip or fails to assert the claim against JRT in due time, all claims will be forfeited.

C.1.8 Liability of JRT for lump sums
For the liability of JRT for lump sums see C. 7.

C. 2 Procurement of mountain railway tickets

JRT acts as an agent for the following cooperating railway companies: Wengernalpbahn AG, Jungfraubahn AG, Bergbahn Lauterbrunnen-Mürren AG, Firstbahn AG, Harderbahn AG, Berner Oberland-Bahnen AG, Gondelbahn Grindelwald-Männlichen AG, Luftseilbahn Wengen-Männlichen AG, Pfingsteggbahn AG, Luftseilbahn Mürren-Schilthorn AG, Bergbahnen Meiringen-Halsiberg AG and Autoverkehr Grindelwald AG. Details can be found in Appendix: D. 1.

C. 3. arrangement of hotel accommodation, holiday flats and holiday homes

The hotels, holiday apartment and holiday home landlords in the Jungfrau Region have commissioned JRT to arrange their accommodation. The contracts are concluded directly with the respective hotels or landlords. Details can be found in the appendix under D.2. and D.3.

C. 4. organisation of events

Events are organised by a third party (third-party service). JRT acts as an agent for the contract with the organiser. The terms and conditions of the respective organiser apply. (Please refer to Appendix D.6.)

C. 5. procurement of ski and snowboard schools and sports equipment

Ski and snowboard lessons are offered by qualified schools. Sports equipment can be hired from a specialised sports equipment shop. These services are organised by JRT. The conditions of these providers can be found under D.4. and D.5.

C. 6. events organised by JRT

In exceptional cases, and this is expressly declared, the JRT itself is the organiser of the event.

The following additional provisions apply to events organised by JRT in its own name: JRT may limit the number of tickets issued to an individual customer. The customer is not permitted to use the publications and other information about the event or the brands and labelling of JRT in order to resell purchased tickets. They may not use tickets for advertising or sales promotion on their own behalf (e.g. public prize draws, inclusion in packages). Commercial trading with the tickets is prohibited. They lose their validity as a result.

C. 7 Liability of JRT

C.7.1 Brokered services
JRT provides the customer with the platform for bookings with third-party companies. JRT is not a party to these brokered contracts and is not liable for the correct fulfilment of the contract.

C.7.2 Booking process and use of the booking platform
These terms and conditions and the GTC apply to the operation and booking process on the platform.

C.7.3 Liability for JRT for JRT's own package holidays
JRT is liable for JRT's own package holidays (package holidays in accordance with the Federal Package Travel Act) within the scope of the statutory provisions. If international agreements, national laws based on international agreements or national laws that limit or exclude liability apply, JRT is only liable within the scope of these international agreements and laws.

For damage other than personal injury, i.e. damage to property and pure financial loss, liability is limited to twice the price per person (unless the damage was caused by gross negligence or intentionally). Further limitations of liability or exclusions of liability in applicable international agreements, national laws based on international agreements or national laws and these General Terms and Conditions are reserved.

C.7.4 Further exclusions and limitations of liability
Liability for auxiliary persons is excluded for services other than package holidays (Art. 101 CO). JRT is not liable for the availability or operation of means of transport and public facilities such as swimming pools, tennis courts, shopping facilities, restaurants, accessibility of hiking and cycling trails etc. or ski slopes etc. which are mentioned for information purposes on the platform or in JRT brochures and catalogues.

JRT is not liable for damages in connection with excursions, events, etc. that the customer books themselves "on site" during their stay or trip (third-party services). This also applies if the relevant documents are available in a facility belonging to JRT or are described on the website. JRT is not liable for wasted holiday time, ruined holidays, frustration damage, etc.

C.7.5 Operation of the JRT websites and links
JRT endeavours to keep the information and details on its websites up to date. Nevertheless, it accepts no liability for the completeness or accuracy of the information and details. In particular, JRT does not guarantee uninterrupted operation or uninterrupted accessibility of the websites. JRT accepts no liability for the consequences of an interruption in operation, website downtime, disrupted or interrupted communication or booking processes. This applies in particular, but not exclusively, to indirect and consequential damage, loss of profit or loss of benefit of any kind.

The use of third-party websites or parts thereof is the sole responsibility of the user, customer. JRT is not liable for the content of such websites etc. or that they are free of malware (such as viruses etc.).

C.7.6 Non-contractual and quasi-contractual liability
Non-contractual and quasi-contractual liability shall be governed by the applicable statutory provisions, with any further exclusions or limitations of liability in these General Terms and Conditions taking precedence.

C. 8. severability clause

Should individual provisions of the contract, these General Terms and Conditions or the Terms of Use and Data Protection be invalid or ineffective, they shall be replaced by a valid or effective provision that comes closest to the original intention of the parties.

The invalidity or ineffectiveness of individual provisions shall not affect the validity or effectiveness of the contract.

C. 9 Applicable law and place of jurisdiction

The relationship between Jungfrau Region Tourismus AG and its customers (clients, buyers) shall be governed exclusively by Swiss law, to the exclusion of any possible rejection. This choice of law clause also covers the question of the conclusion and validity of the contract. The application of the "Vienna Sales Convention" (United Nations Convention on Contracts for the International Sale of Goods, CISG) is expressly excluded.

The exclusive place of jurisdiction is Interlaken, Switzerland.

Mandatory provisions that cannot be contractually amended remain reserved.

D. Appendix: Notes on the individual service providers (third-party services)

D. 1. Jungfrau-Ski Region

Several providers, including in particular Firstbahn AG, Gondelbahn Grindelwald - Männlichen AG, Wengernalpbahn AG and Schilthornbahn AG, form a subscription network under the Jungfrau-Ski Region brand. All companies are independently responsible for the operation of the lifts and pistes. The transport contract is concluded directly with the customer and the respective lift operator. The latter is responsible for the proper provision of the corresponding services. It is also responsible for the necessary technical maintenance of the facilities and the duty to ensure road safety (piste and avalanche service). Accordingly, liability issues, in particular in connection with skiing accidents, are dealt with by the respective company in whose territory or on whose facilities the incident occurred. The Jungfrau-Ski Region has issued a tariff (GTC JSR), which forms part of the contract for every Sportpass purchase. The relevant provisions are listed below:

Sports passes are personal and non-transferable. Points cards can be used by several people. They expire 3 years after the date of purchase and may only be used during the winter season. Sports passes authorise unlimited use of the respective ski region. Special events, namely the Lauberhorn race, are reserved. The Grindelwald ski bus network and the Lauterbrunnen local bus services are included in the offer. Hiking and sledging passes allow free travel from Grindelwald to the Bussalp. Sports passes are not valid for extra and evening journeys.

For sports passes that are valid for several days, the period of use begins at 00:00 on the first day and ends at 24:00 on the last day. The use of seasonal sports passes is permitted in November, provided that winter operations have already opened in the ski area concerned. During the summer season, your season sports pass serves as a personal half-day pass on the following mountain railway routes in the Jungfrau region: Grindelwald-Kleine Scheidegg-Lauterbrunnen/ Kleine Scheidegg-Jungfraujoch/ Grindelwald-First/ Grindelwald-Männlichen/ Wengen-Männlichen/ Lauterbrunnen-Mürren via Grütschalp/ Stechelberg-Mürren-Schilthorn/ Mürren-Allmendhubel/ Wilderswil-Schynige Platte/ Interlaken-Harder. Season sports passes are valid for occasional single journeys on the following routes: Interlaken Ost-Lauterbrunnen/Grindelwald (BOB)/ Lauterbrunnen-Wengen (WAB)/ Lauterbrunnen-Mürren (BLM)/ Lauterbrunnen-Stechelberg (PAD)/ Stechelberg-Mürren (LSMS).

In particular, all school and business trips are excluded. Sports passes only entitle the holder to travel in 2nd class. If a 1st class seat is used, half of the price difference must be paid as a class change fee. Sports Passes must be presented without being asked at transport companies without an electronic reader. In the case of an online purchase, the guest legitimises himself by means of a printed confirmation of purchase. An identity card must always be carried along with the eTicket. If the eTicket is valid for 30 days or more, a photo is required to create the sports pass. The electronically recorded personal data is stored in a database. The holder's photo appears on an internal computer when they pass through a reader. If sports passes are issued as a KeyCard, a deposit fee is charged. In the event of a damaged KeyCard, no deposit will be refunded. The FIS rules of behaviour and SKUS guidelines must be observed. Instructions from the piste and rescue services must be followed. Outside railway operating hours and after the final inspection, the pistes and slopes are closed and therefore off-limits. In the event of reckless behaviour (in particular disregarding the FIS and SKUS rules, disregarding signals, instructions and barriers, skiing in forest and wildlife protection zones and on slopes at risk of avalanches), the ski pass may be withdrawn. It is not possible to exchange the sports pass. There is no entitlement to a refund in the event of service interruptions. This applies in particular to the closure of ski areas or parts of ski areas due to weather conditions, lack of snow, avalanche risk, premature thinning of the ski slopes, etc. Special events may entail the closure of certain parts of the ski arena and the construction of a spectator area. The Sportpass does not grant you access. The customer is responsible for these inconveniences. The specified operating times of the winter sports facilities are for information purposes only. Compliance with them requires appropriate snow and piste conditions. If a ticket holder invokes compelling reasons independent of his/her will, an appropriate refund can be made if the holder can no longer use the Sportpass. The holder must deposit the Sportpass at a point of sale. A refund will only be made for days on which the sports pass was deposited before 10 am. Lost Sportspasses will generally not be replaced. This applies in particular to passes with a validity period of two days or less. A new Sportpass will be issued for Sportpasses with a longer validity period. Proof of purchase is required for this. It is up to the purchaser to prove that they were the holder of the pass. The circumstances of the loss and the efforts made to recover the pass will be recognised. Two further conditions must be met for season sports passes. A fee of CHF 25 will be charged. A report of loss submitted to the police must be presented. The sports pass may only be used by the authorised person. Anyone who does not present a valid sports pass at an inspection must pay for a normal day ticket. If the guest was in possession of a valid pass at the relevant time, a refund of the amount of the day pass can be requested within 7 days. A processing fee will be charged. Acts by a guest with the intention of unlawfully enriching themselves or another person and/or damaging the transport company's assets or other rights are deemed to be misuse. Forgery is deemed to have taken place if a sports pass or a receipt has been created, altered, duplicated, supplemented or otherwise manipulated without authorisation or has been erased. Sports passes that have been misused may be confiscated as evidence. The duration of the confiscation of the misused sports pass must be limited to the time required for the necessary clarifications. A regular day sports pass must be cancelled. In the event of misuse, a surcharge of CHF 100 will also be levied. In the event of forgery, this surcharge is CHF 200. The passenger fare 600.5 applies to train journeys. Anyone who does not pay the aforementioned amounts immediately must provide security. Otherwise the guest may be expelled from the ski area. If a security deposit is ordered, payment must be made within three days. Otherwise the case will be forwarded to the office and further charges may be levied. An incomplete attempt at unauthorised use has the same consequences. Civil and criminal prosecution remain reserved

D. 2. hotels

With the hotels that can be placed in the shopping basket as individual items, the customer concludes a contract with the selected hotel brokered by JRT. Each hotel has its own contractual terms and conditions, which can be obtained via the website or directly from the hotel. The hotels apply the following standardised cancellation and rebooking conditions to the customer. Hotel services that have been booked via the JRT booking platform can only be cancelled or rebooked via the JRT helpdesk. If a cancellation or rebooking is made 5 days or more before arrival, the cancellation fee is 100% of the booked hotel price. If a cancellation or rebooking is made more than 5 days before arrival, a processing fee of CHF 50 will be charged.

Local taxes and taxes are included in the prices. Extras such as minibar, room service, car park fees etc. are charged separately by the hotel directly. The customer is advised to enquire about the extras and their price at check-in.

In the event of complaints, damage, etc., the customer should contact the hotel directly. The hotel will clarify the matter with the customer on its own authority. The hotel's liability is governed by its own terms and conditions.

The contracts with the hotels are subject exclusively to Swiss law. The parties agree that the exclusive place of jurisdiction shall be the location of the hotel. Mandatory statutory provisions that cannot be contractually amended remain reserved.

D. 3. holiday flats and holiday homes

Online bookings of holiday flats and holiday homes are processed via the e-domizil web platform. During the booking process via the JRT website, the customer is redirected to an e-domizil booking platform (https://apartment.jungfrauregion.swiss). JRT has no exclusive influence on the content and functioning of this platform and can therefore accept no liability for it. The operator e-domizil or the respective holiday home landlord is always responsible for the content of the linked website and the individual advertisements.

The customer concludes the rental contract directly with the holiday apartment landlord. JRT does not act as a contractual partner or agent for the rental agreement. The legal framework conditions of the e-domizil booking platform always apply.

D. 4. ski and snowboard school

The booking platform can be used to book lessons and childcare services provided by Grindelwald Sports AG and Genossenschaft Schweizer Skischule und Snowboardschule Wengen (third-party services). The Grindelwald Sports AG and Genossenschaft Schweizer Skischule und Snowboardschule Wengen booking conditions are published on their websites.

The customer concludes his contract directly with the snow sports school of his choice. Any changes to the contract, cancellations etc. must be handled directly with the booked ski or snowboard school.

Note: JRT can also use other professional ski and snowboard schools for JRT package deals.

D. 5. sports equipment / equipment

On the booking platform, JRT arranges the hire of equipment through the company INTERSPORT Rent-Network Jungfrau Region Tourismus AG.

D. 6. event tickets from external providers

JRT acts as an agent for event tickets. The customer concludes the contract directly with the organiser. The organiser has its own contractual terms and conditions, which it publishes itself or can be obtained directly from the organiser. As far as possible, these will be published when the event is advertised. If an event has to be cancelled or postponed, the organiser's terms and conditions apply. The tickets remain valid for any replacement event (postponement date). Returns or exchanges are excluded unless otherwise stated by the organiser.

Event tickets cannot be returned or exchanged by JRT. As an agent, JRT has no influence whatsoever on the quality and manner in which the event is organised or on the personnel management and security concepts. These must be obtained directly from the organiser. These events are third-party services and JRT is not liable for the organisation or execution of the event.

D. 7. Lauterbrunnen multi-storey car park

On the booking platform, JRT arranges the reservation and rental of parking spaces in the car park of Parkhaus Lauterbrunnen AG against advance payment. Bookings can be made for a minimum of 5 days and a maximum of 31 days. Parkhaus Lauterbrunnen AG makes the reservations under the following rental conditions:

A pre-booking and reservation of a parking space via the booking platform cannot be changed, cancelled, rebooked or refunded. No refunds will be made for late arrivals or early departures. The reservation does not give rise to any obligation or entitlement to the use of a specific parking space. The car can be parked in any free space.

The car number given when making the reservation is used by the car park staff to simplify access on busy days and as an indication of authorisation (copy protection). However, entering the car number does not "personalise" the reservation within the meaning of these GTCs. The provisions on the protection of subscription authorisations (vouchers) against theft or unauthorised duplication must therefore be observed in all cases. The voucher must be kept within reach of the driver in the passenger compartment when entering the car park for the first time (arrival). It must be presented to the car park staff on request. A car park ticket must be obtained at the entrance by entering the five-digit parking code on the voucher. The car park ticket is valid for the entire duration of the reservation and can be used multiple times to enter and exit the car park. If a normal ticket is purchased on entry (by mistake or if the voucher is forgotten), it must be recoded with the five-digit parking code at an automatic pay station for the duration of the reservation. Lost or forgotten vouchers can be reprinted at any time in the user account of the booking platform; lost car park tickets will be replaced on presentation of the voucher.

The multi-storey car park is open at all times. Use of the car park is subject to a charge in all cases and for the entire duration of use. If you arrive before the rental period booked online, a normal ticket can be purchased and recoded at the ticket machine after the start of the reserved period. The additional time purchased must be paid for directly at the ticket machine. However, there is no guarantee of a free space before the rental period booked online begins. If the departure takes place after the expiry of the online booked rental period, the ticket must be extended at the automatic pay station. The additional time purchased must be paid for directly at the automatic pay station; there is no payment option at the exit barrier. Leaving the car park without a valid parking ticket is prohibited.

Parkhaus Lauterbrunnen AG accepts no liability for damage or accidents of any kind caused by third parties or theft. It has issued the following house rules for car parking: The multi-storey car park is intended exclusively for the parking of light motor vehicles. It is not permitted to drive or use the car park and the associated spaces with play and sports equipment (rollerblades, inline skates, etc.). Car park users are liable for any damage they cause to other parked vehicles, to equipment and installations or to the building. Any damage caused must be reported immediately to the attended car park counter or to the on-call number +41 (0) 79 710 60 20. The traffic signs and signs posted and the instructions of the car park staff regarding traffic control must be followed. All provisions of the Swiss Road Traffic Act (SVG) and its ordinances apply. Vehicles must be parked within the marked spaces. The car park is intended exclusively for parking cars. It is not permitted to store other objects / materials in the car park. Repair, maintenance and cleaning work on parked vehicles is prohibited. Excessive noise (honking alarm systems, etc.) must be avoided. Unnecessary running of engines is prohibited. Faults must be reported immediately to the attended car park counter or to the on-call number +41 79 710 60 20. The display and distribution of advertising of any kind is not permitted without the authorisation of Parkhaus Lauterbrunnen AG. The dumping and disposal of rubbish is prohibited.
